Iowa bill would jail raped women for ‘murder’ of single-cell zygotes | The Raw Story

A bill introduced by nine Republican state lawmakers in Iowa on Wednesday would define abortion as “murder,” sending doctors and raped women who terminate pregnancies to jail.

State Rep. Tom Shaw says that he authored House File 138 to protect human life, whether “you’re a zygote, an infant, a teenager or an adult.”

The bill defines a “person” as “an individual human being, without regard to age of development, from the moment of conception, when a zygote is formed, until natural death.”


“Murder includes killing another person through any means that terminates the life of the other person including but not limited to the use of abortion-inducing drugs,” the measure states without making any exceptions for rape or incest.

Republican state Rep. Rob Bacon, who is co-sponsoring the bill, told the Ames Tribune that he wanted to “protect the life of the unborn” because “[t]here’s still some of us that believe life begins at conception.”

During a Wednesday interview with Denver Bible Church pastor Bob Enyart, Shaw explained that defining a fertilized egg as a “person” in Iowa’s murder statute “just simplifies everything.”

“So when anyone has any questions towards us — the war on women, are you doing this, are you doing that? — no, it’s a simple response,” he insisted. “We are only defining who a person is.”

I fear for the USA; with elected representatives so profoundly disabled when it comes to engaging in informed debate and decision-making, and those same representatives supporting the dumbing down of facts in education, it looks from the outside as though the nation, in another generation, could spiral into a vortex of superstition. It’s said that a people get the representation they deserve, but the maxim collapses when those people miss out on the education everyone deserves. I used to think there was a deliberateness, a duplicity if you like, behind the disempowering decisions that at times come from State and Federal lawmakers, but maybe the USA is increasingly suffering from the consequences of prosperity fundamentalism, creationist mumbo-jumbo, and a blind bacchanalian chase for growth and consumerism. The USA is, of course, not alone on this perilous path, and we can see humanity groaning under the load it carries on that particular journey.

    If the electorate share his beliefs then he will get elected. That’s one of the tricky aspects of democracy. You really need to educate your population for best outcomes.

    You believe the entire universe was created by a supernatural being (which has almost certainly been disproven).
    You believe humans are the summit of creation (which has been disproven).
    You believe humans have a soul (which has almost certainly been disproven).
    You believe life begins at conception (which depends on how you define life).
    You believe your beliefs and opinions are more important than other people’s (which is immensely arrogant).

    But you have not supplied any evidence supporting any of these contentions (and almost certainly cannot).

    In the US you have legal separation of religion and government, so stop interfering in government based purely on a religiously inspired belief that others don’t share.

    1. A health care provider who initially identifies and
      18 diagnoses a spontaneous termination of pregnancy or who induces
      19 a termination of pregnancy shall file with the department
      20 a report for each termination within thirty days of the
      21 occurrence.The health care provider shall make a good faith
      22 effort to obtain all of the following information that is
      23 available with respect to each termination:
      24 a. The confidential health care provider code as assigned
      25 by the department.
      26 b. The report tracking number.
      27 c. The maternal health services region of the Iowa

    Actually line 5 was a strike through that didn’t copy over and “induced” was a strike through also.
    How do they not see themselves as Big Brother? What about the 4th Amendment? Why is the marital status and last mentral period info wanted and needed? Let’s say by weird chance, in future world, this Bill was enacted nationwide. This would then give them the power to nosey into women’s confidential health matters, and know about sexual activity when unmarried. Then move forward in time…it could then allow them to control and punish unmarried women for having sex. Ultimately, I think their goal is to force women barefoot and “legitimately” pregnant back into the kitchen. Republicans are moving more and more towards Muslim extremists views of women (how don’t they see this) Did you read that stupid woman’s site? She describes herself as “constitutional.” These people are eroding away the constitution. What she is really proposing is that she force herself and all women back into the kitchen and out of public office.

    to the U.S. Supreme Court of a hypothetical murder case based on the hypothetical presumption that this stupid statute actually got passed in Iowa???. Though they’re occupationally insulated from public opinion,
    the pressure on those Justices to overturn a murder verdict in light of the legal understandings emanating
    from Roe v Wade would be enormous.

    I think bills like this are introduced so that when they don’t pass, the backers can say, okay, we’ll bring it down a little: no jail time for the woman who has an abortion, only for the doctor who performs it; the important thing is the life of the child.

    It makes them appear reasonable and open to compromise, and the pro-choice constituency, by contrast, intransigent.

    Or I could be crediting them with a Machiavellianism they don’t possess and they are, as AfraidToDie says, all just batpoop crazy.

    Given Tom Shaw’s unequivocal definition of murder and his insistence that “We are only defining who a person is” I wonder where he stands on the death penalty issue.

    This is not a helpful comment. There is a continuum of development from fertilization to birth, and the fetal stage is all but about the first nine weeks. A nine-week fetus is certainly not a “person” in any but the “religious” sense, but anyone who thinks a full-term fetus just short of birth is any less a person than a newborn has a poor grasp on reality. At the very least, anyone who holds this ridiculous view is not a parent.

    It happened around 1100 AD when Al-Ghazali said that if science contradicts islam or the koran then the science is wrong. Once he developed a following for this dogmatic bullshit, that’s all it took to start the downward slide from which the Arab world has never recovered, I see a lot of similarities between Al-Ghazali’s anti-scientific stance and the Republican’s disdain for anything scientific that they don’t like.

  24. The most general established meaning of the term ‘person’ is (according to the Collins English Dictionary) “an individual human being.” What Rep. Tom Shaw has not troubled himself to explain is why a zygote should be considered a human being? Yes, it is the product of two gametes combining in the womb, one from a man and one from a woman, and this is the beginning of the process whereby a new human being takes form. It is a pity the interviewer was so sympathetic to the Representative, for he might otherwise have asked why the zygote should be accorded the full dignity of a human being in law, comparable to that of the woman whose womb contained the zygote, and then the interview might have become at least interesting.

  26. this will be hard to police. every misscariage, every time a second pregnancy test that fails to confirm the positive result of the first, every time someone claims to be pregnant but seems to have suffered a fake pregnancy and every time someone is rumoured to be pregnant who turns out to not be will now have to be investigated as potential murder cases.

    although i suspect it’ll be one of those laws that’ll be used only when it suits the wingnuts. i mean they’re not going to enforce it every time they get the maid pregnant now, are they?

  28. Nowhere in the Torah, the Prophets (the Old Testament) or the canonized gospels and accepted epistles (New Testament) is there any claim that any zygote or fetus has rights. To the contrary, the Bible says (Genesis 2:7) that life begins when the body outside of the uterus breathes. Job 33:4, a Babylonian legend that was plagiarized and cut-and-pasted into the corpus of the Old Testament, confirms this idea that was universal from ancient Egypt to India. Ezekiel 37:5-6, one of the prophets, also declares this, and the Jesus of the New Testament remained silent about abortion, when life began, marriage, homosexuality and all other hot spots of concern to evangelical extremists from Scott Lively to Bryan Fischer in the USA and Anders Brevik the mass murder and Christian terrorist in Norway.
