El Salvador court denies seriously ill woman abortion

The Supreme Court of El Salvador has refused to allow a seriously ill pregnant woman to have an abortion, even though her foetus has almost no chance of survival


Lawyers for the young woman – who suffers from lupus and kidney failure – had argued that continuing the pregnancy would place her life at risk.

The foetus itself is missing part or all of its brain.

All abortions are prohibited in El Salvador under any circumstances.

The constitution in the majority Roman Catholic country protects the right to life "from the moment of conception".

The 22-year-old woman – referred to as "Beatriz", not her real name – is said to be in fragile health, suffering from the chronic immune disorder lupus as well as kidney failure.

Tests suggest her 26-week-old foetus is developing without a complete brain, a condition called anencephaly. Almost all babies born with this condition die before or shortly after birth.

  1. How does one start combating such widespread and diverse barbarity in our world?

    First the story from Nigeria and now this cruelty from El Salvador, not to mention the continual nonsense in our neck of the woods. Some days you just don’t know where to start.

Male Religious leaders can command Male law makers to command Medical doctors to command a female and practically own her body and force her to possibly sacrifice her own health or life to give birth to a irrepairably ill foetus that will not suceed in surviving…This is outrageous religious insanity gone nuts and is surely taking away all the womens human rights. Its sexist and prejudice misogyny and its disgusting. This event is sadly not isolated only recently in Ireland was a similar case where a women died after being refused an abortion, Shame on you Ireland, but even more so – shame on you Catholic Church. It is all Your Fault……The article showed some statistics, in West Europe abortion is legal and only 12 in 1000 women require one, but in Latin America where it is not legal 32 in 1000 seek abortions, maybe if birth control was available to prevent pregnancy – women wouldn’t have to consider termination or risk loosing their own lives. Women are lifegivers not Men, not Religion not Law, none have any greater say over Womens bodies than women.

    Might religiosity just be a very commonly occurring type of anencephaly where the affected babies go on to live normal human life spans?

  4. Surely had some parasite invaded the woman, this is not considered protected life. A tumor is not protected life. This thing inside her is not even a potential child. This is rule-based thinking run amok.

  5. Pre-medieval barbarism.

    The Vatican/Pope needs to stop countries passing laws which have such a cruel effect (Nicaragua has killed over 100 mothers so far), and urge the repeal of existing laws.

    This is, simply, a matter of denying the most basic of human rights, the right to life. You’d have thought the Catholic church would be onside for that one, but apparently crass stupidity prevails over reason.

    It appears she has now been given “permission” to have a C-section. Evidently this is “induced birth” and not abortion and is consequently OK with Sir.

    This isn’t exactly a solution, C-section is major surgery and she probably shouldn’t be having it in her condition.
    Lupus isn’t a contraindication for C-section but the mortality rate is higher for those with Lupus, couple that with her kidney failure, which is a not uncommon complication of C-section, so it could exacerbate her kidney failure to a critical point.
    The only reasonable option medically would of course be a termination.

  7. Also, I’ve no doubt that if she does undergo a C-section, and the baby will no doubt not survive, opponents will claim that the C-section is what caused the baby’s death, not the anencephaly, and criticise the doctors for trying to intervene in the pregnancy.

What disgusts me is that these inhumane laws are the direct result of the Catholic teachings, but when the child is born and dies soon after, and the mother might die too, the funeral will be Catholic. The god will be praised for making the right choice, for watching over the baby and the mother, ending their suffering and taking them home to heaven. Then they will praise the god for being infinitely just, good and caring. The death of the baby, and maybe even the mother, after needless suffering was all part of god’s mysterious plan. We might not understand it, but because it comes from god it must be good, and we should not at any point intervene, not even to relieve the suffering of the victims.

      Presumably it means in a Roman Catholic country your life is protected from conception until you conceive. Then all bets are off. If you are a women. If you are a man then your life is protected all the time.

  10. So much for NOMA… Like Prof. Dawkins said, I wouldn’t mind religion so much if they didn’t always keep meddling into scientific/medical matters or more importantly into people’s private lives. Now this woman is in danger of dying, just like that poor woman who died in the Irish Catholic hospital about a year ago because the of the hospital’s policy to not abort a fetus while there’s still a heartbeat.

    This is just sickening!!!

  11. Of course the bigger scandal, again,is the complete failure of countries, international entities – UN etc, for fear of being seen as impinging on (oxymoron alert) “religious freedom” and national sovereignty, to bring diplomatic/economic pressure to bear to send a clear civilizing signal.

  12. Not so simple solution is to get her out of the country. Somebody should provide a mechanism to to so and a drive for funds. If it works then spread it to other countries. Complaining is fine but doing is more important.

  13. The misery cult’s position is that the mother and fetus have equal rights. It’s abortion doctrine is available in the abortion article in the online Catholic Encyclopedia. Here you can read the theory and see how it’s glued together.

    One should not give rights to anything or anyone growing inside you; the prospect of being forced to do so would be a nightmare.
